Donna Branch-Gilby is replacing Paul Eckerstrom as the Democratic Representative to the Commission.

  • Priority # 1 Recruiting election board members and volunteer observers for the City Election
  • Looking ahead to 2010--Recruiting poll workers
  • Develop a Reference Manual
  • Putting political pressure through a letter-writing campaign on the County Supervisors to increase transparency, adhere to predictable schedules for county elections.
  • Preserve hand count audit gains by lobbying the legislature
  • Status of U.S. Electoral History Power Point Presentation
  • The DOJ has rejected Georgia's system of using Social Security numbers and driver's license data to check whether prospective voters are citizens, a process that was the subject of a federal lawsuit before the November election. Potential impact on Arizona's Prop. 200
  • The Supreme Court later this year will rule on the constitutionality of Sec.5 of the the 1965 Voting Rights Act. The ruling could potentially weaken the Voting Rights Act. Arizona would be in a position of needing to police its own voter rights laws. The Secretary of State is not equipped to do this. Need for an independent nonpartisan preclearance commission.

I look forward to discussing these issues with you on Wednesday. Even though it is summer vacation time, we need to do the ground work that will prepare us for the tasks ahead.

What is the Democratic Party Thinking?


It is hard to even contemplate what the Democratic Party is thinking in opposing this bill. They have been on the forefront of such excellent legislative and election transparency initiatives. Their own EIC committee supports the bill. The message below is from the Pima Democratic Party EIC Co-Chair Sandra Spangler:

Support SB 1053

Extend Citizen Oversight to Nonpartisan Elections


Monday, June 2, 2008 SB 1053 as amended is scheduled for final vote in the Arizona Senate. The Arizona House adopted the amendments proposed by the Conference Committee on May 28.

Since a minority report filed by Democratic Rep. Steve Gallardo raised concerns that amendments added to the bill will codify into law a shorter voting period for early voting, it is uncertain whether Governor Napolitano is prepared to sign this bipartisan bill that earned overwhelming bipartisan support. If the Governor decides to veto the bill, other corrections to the bill that avoid scheduling city and county elections too close together will not take effect and Democrats will be blamed.

Pima County Recorder F. Ann Rodriguez and other election officials support SB 1053.

Pima County Democratic Party Files Lawsuit Against Board of Supervisors


"A hearing has been scheduled by Pima County Superior Court Judge Charles V. Harrington at 1:30 pm on Monday, May 14,2007 on the Pima County Democratic Party’s request for an order requiring the county to turn over to the party its stored computer data from past elections. The hearing is called an Order to Show Cause hearing and at that at time Chuck Huckelberry and the Pima County Election Department will be required to present evidence specifying why it would harm the public interest if the history of past elections was known to Pima County’s largest political party.

By statute the Pima County Board of Supervisors run our county and state elections. Although three of the elected supervisors were nominated and elected as Democrats, nonetheless, Supervisor Valadez and Supervisor Bronson have consistently opposed the party’s efforts to obtain public records from the county and have forced their own party to sue. At the recent County Convention a resolution was unanimously passed requesting their cooperation, but they have ignored the resolution and have refused to help their party."

"What we have documented from Public Records Request, Depositions from Pima Co Election Department central tabulator, Diebold GEM audit log clearly shows serious problems.

The County manger Chuck Huckelberry and his Attorney are trying to find a rabbit hole to put the case down. There is a possibility that on or before May 14th at 1:PM in Judge Charles Harrington hearing could be canceled and if it is we'll meet on the court steps and have Bill Risner, Donna Branch-Gilby, and Vince Rabago, Dr Ted Downing, and hopefully Earnest Hancock and others address the group. The suit is against Pima County Board of Supervisors.

William "Bill" Risner is the attorney of record for Pima County Democratic Party. To quote Pima County Democratic Party’s Attorney Bill Risner in his reply to the court:

"The defendant Pima County has asserted that the sky will fall and the sun will not rise in the morning if the Democratic Party obtains the past election data they seek."

For over 2 years we have been investigating Pima County Election Department and we don't like what we're have found. They have illegally been printing of election results up to 8 days before the election using the mail in early ballots. This has been going on since the primary of 2004. We know how the backdoor works with the GEMS/Diebold system and how it could be easily hacked using MS-Access.

They've known about the backdoor since 1996: Several Pima County bureaucrats from the very top down have known about the backdoor in our voting system. This odd procedure is not found in the 548 page Diebold's User Guide for our voting software, nor does explain that the system is built upon Microsoft Access. Furthermore, by using MS-Access, in less than a minute; a person could switch election by changing two positions in the candidates table (in Access) flipping an election all the way down to the precinct level. "

News on Upcoming Events


The lawsuit Pima County Dems voted to support at the county organizing meeting last month, demanding records the county is denying access to around the early reports pulled from early (VBM) ballot data, may be filed this Wednesday.

John Brakey and Bill Risner will be speaking at the County Board of Supervisors:
Wed, 1/31. Around 2:30 PM.


Two supervisors, Chair Richard Elias (D) and Ray Carroll (R) are working with EIC, and they should be thanked. You can email your thanks to each supervisor by clicking on their names above. The others must be lobbied.

Brad Friedman form Bradblog
, a leader in reporting on election integrity issues nationally, will be in Phoenix to do two radio shows on Air America
1480 KPHX, on Thursday and Friday Feb. 1st & Feb. 2nd 2007. He may be in Tucson on Wednesday, Jan. 31st. Save Wednesday evening just in case, and if you can attend the County Supes this week, please do so. In Phoenix there will be a gathering on Friday, I believe, stay tuned for details.

Finally, David Waid and Donna Branch Gilby, Chair and Vice Chair of the Arizona Democratic Party, are carrying a friendly amendment authored by AUDITAZ and others, putting extra power into the DNV election integrity resolution when they go to DC later this week for the DNC quarterly meeting.
